Terms of Service

These Terms of Service (“Terms”) are a binding agreement between Swadesh Mobile Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 1108, Sureshwari Techno IT Park Premises CHS, Link Road, Borivali West, Mumbai, Maharashtra 400092, India, operating the 9278.io platform (“9278.io”, “Company”, “we”, “us”), and the business customer that registers for or uses the Services (“Customer”, “you”). By creating an account or using the Services, you accept these Terms, the Acceptable Use Policy, the Privacy Policy, the AI Voice Disclosure & Responsible-AI Policy, the Call Recording & Consent Notice, the Data Processing Addendum, the Grievance Redressal Policy, the Refund & Cancellation Policy, and the Service Level Agreement. The Services are offered to businesses in India only.

1. THE SERVICES

9278.io provides AI voice-agent (“AI receptionist”) software for Indian businesses — inbound call answering, multilingual conversation in Indian languages, intent detection, appointment booking, call forwarding/routing to your numbers, call recording, real-time transcription, analytics, and the provisioning of Indian phone numbers (DIDs) through licensed telecom service providers. Features depend on your plan. We may add, change, or discontinue features with reasonable notice of material changes.

2. ELIGIBILITY AND ACCOUNTS

You must be a business (or person acting for business purposes) able to contract under the Indian Contract Act, 1872, and must provide accurate registration and KYC information (including any details required by telecom regulations). You are responsible for all activity under your account, your agents/users, and credential security, and must notify support@9278.io of suspected unauthorised access.

3. YOUR COMPLIANCE OBLIGATIONS (IMPORTANT)

Because the Services place, answer, record, and forward calls, you are responsible for using them lawfully. You agree to comply with the Acceptable Use Policy and all applicable Indian laws, including the Digital Personal Data Protection Act, 2023 (DPDPA), the Information Technology Act, 2000 and rules, the Telecommunications Act, 2023, TRAI’s Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR) and the DLT framework, and the Consumer Protection Act, 2019. In particular you must: (a) obtain the consent and complete the DLT/NCPR/DND requirements for any outbound or commercial communication; (b) disclose to callers that they are interacting with an AI/automated agent and that calls are recorded, where required; (c) where 9278.io processes personal data on your behalf, act as the Data Fiduciary with 9278.io as your Data Processor under the Data Processing Addendum; and (d) be responsible for your agent scripts, prompts, knowledge sources, and the lawfulness of your campaigns.

4. PHONE NUMBERS AND TELECOM

Indian numbers provisioned through 9278.io are obtained via licensed telecom service providers and are licensed to you for use while your subscription is active; you do not own them. Use of numbers and SIP connectivity is subject to TRAI/DoT rules, the numbering plan, and the telecom providers’ terms. We do not bypass licensed telecom networks. Numbers may be reclaimed on non-payment, lapse, or breach.

5. FEES, WALLET, GST

Plans and per-second usage rates are shown on our pricing page and billed as wallet credit in Indian Rupees (₹). We issue GST tax invoices. Included minutes, overage rates, and number rental are as stated in your plan. Wallet credit and minutes are valid for 60 days from the date of top-up. Unused wallet credit may be refunded on request within 14 days of top-up, less any minutes already consumed and applicable charges/taxes; used minutes and number-rental fees are non-refundable. You may cancel any time from your dashboard or by emailing support@9278.io. See the Refund & Cancellation Policy for full details. Applicable GST and other taxes are payable by you.

6. TERM, SUSPENSION AND TERMINATION

Plans are billed on a recurring basis and continue until cancelled. We may suspend or terminate immediately where required by law, TRAI/DoT, or a competent authority, for fraud, illegal traffic, security risk, non-payment, or breach. You may cancel any time per the Refund & Cancellation Policy. Your statutory consumer rights are not affected.

7. SERVICE LEVELS

We provide the availability commitment, support targets, and service credits in the SLA. Service credits are your sole and exclusive remedy for availability shortfalls.

8. CUSTOMER DATA, CONTENT AND IP

You own your data, prompts, scripts, knowledge sources, and recordings; 9278.io owns its platform and software. You grant us the limited rights needed to host, transmit, route, record, transcribe, store, and deliver your communications and to provide and secure the Services. We will not use the content of your calls, recordings, or transcripts to train generative AI/ML models without your documented consent.

9. EMERGENCY CALLING

The Services are not a substitute for emergency calling. The AI agent and the platform are not designed to place or route emergency calls (e.g. 112/100/101/102). Maintain an alternative means of contacting emergency services.

10. WARRANTIES, LIABILITY AND INDEMNITY

Except as required by law, the Services are provided “as is”. To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, and our aggregate liability is limited to the fees paid by you in the 12 months before the event, except for liability that cannot be excluded under Indian law. You indemnify us against third-party or regulatory claims arising from your content/campaigns, your breach of these Terms or the AUP, your unlawful use, your failure to obtain required consents or DLT/DND compliance, or AI agent configurations you control.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of India; the courts at Mumbai, Maharashtra have jurisdiction, subject to any mandatory consumer-protection forum. Disputes may also be raised through our Grievance Redressal Policy and, for consumers, the relevant consumer forum.

12. CHANGES, NOTICES, GENERAL

We may update these Terms on reasonable notice (posted on 9278.io). Notices to legal@9278.io and your account email. Force majeure, assignment (we may assign to a successor/affiliate), severability, and entire-agreement apply.
